Now onwards in this document, the word "BASE" means and represents the company 'BASE Educational Services Private Limited' , a company incorporated as per the Companies Act, 1956. The material on this site is protected by international copyright and trademark laws. Termination
This agreement is effective until terminated by BASE Educational Services Private Limited, at any time without notice. In the event of termination, you are no longer authorized to access the bulletin boards and the restrictions imposed on you with respect to material downloaded from the bulletin boards, the disclaimers and limitations of liabilities set forth in this agreement, shall survive.

Membership and Billing
You can find the specific details regarding your subscription with BASE at anytime by clicking on the "My Account" link, located at the top of the pages of the BASE web site after you login.

* Free Live BASE (Trial)/Free Trial
We encourage the use of our service through free trial. Free trial is only available to first time customers of the BASE service and cannot be combined with any other offer. Only one free trial may be redeemed per student. You must have internet access to use the free trial offer. Upon registering for your free trial, a TutorVista tutor or a customer service representative will chat with you and try to help you out with your questions. At the end of the free trial period, wherever applicable the customer may be automatically enrolled in the monthly subscription. Unless the customer has notified BASE that he/she intends to cancel prior to the end of the free trial period.

* Billing
By using the BASE service, you are expressly agreeing that we are permitted to bill you a course/subcription/items subscription fee, for your use of the BASE service. As used in these Terms of Use, "billing" The subscription fee will be billed at the beginning of your subscription and your account and subscription item services will be automatically enabled for the subscription period. Without prior notice to you, subscription can be terminated because any internal reason. whether you cancel your membership or we terminate it. In b/w we may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by e-mail or at centers office notice board. If you want to use a different Payment Method you can use to update your subscription services. In case if any of the course/subscription item expiry then the same course/subscription items can be re-subscribe one more time by paying required amount to extend our service(s) as per the terms and condition applied.

* Cancellation and Refund
We are so confident about the quality of our tutors and the convenience and effectiveness of BASE's online services for the subscription/subscription items/courses that we let you cancel your subscription anytime. To cancel, you can get in touch with our Subscription Department by call us on BASE number provide under contact us section. However, we follow a strict No Refund policy. Please Note: For your safety and convenience, we verify customer details before cancelling your subscription. Please use your Subscription Number and login email in all communication with us. Leaving a voice mail, sending an email or posting a message on Customer Care chat will NOT lead to a cancellation of your account

Service Testing
From time to time, we test various aspects of our service, including service levels, plans, promotions and pricing, and we reserve the right to include you in or exclude you from these tests without notice.

Conduct
You may only access the site and use the Company Content and the Services for lawful purposes. You are solely responsible for the knowledge of and adherence to any and all laws, rules, and regulations pertaining to your use of the Services. You agree that you will treat the tutors with respect and not use obscenities in the classroom, make threats, or discuss matters other than those directly related to the academic subject for which you seek help. You agree that you will not solicit any personal information from any tutor, and agree that if any tutor ever discloses such information to you, asks you for any personal information, or suggests any offline meeting or conversation, you agree to immediately report this to us by phone and in writing.

Limitations on Use
You must be 18 years of age or older to subscribe to the BASE service. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian. Unless otherwise specified, the content on the BASE web site is for your personal and non-commercial use and we grant you a limited license to access the BASE Web site for that purpose. You may not download (other than through page caching necessary for personal use), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the BASE Web site without our express written consent. BASE does not promote, foster or condone the copying of copyrighted material or any other infringing activity. *Registration
To use the Services, you will need to register on the site, pay any applicable fees, and obtain an account, and password. You are solely responsible for maintaining the confidentiality of your account(s), and password(s) and for all activities and liabilities associated with or occurring under your account(s), and password(s).You agree to (a) provide true, accurate, current and complete information about yourself as prompted by the Service's registration form (such information being "Your Data"), (b) maintain and promptly update Your Data to keep it true, accurate, current and complete. You agree not to use the site, the Services or the Company Content to recruit, solicit, or contact in any form Tutors or potential Consumers for employment or contracting for a business not affiliated with us without our advance written permission.

*Hours of availability
BASE provides a 24X7 tutoring service. Services are available around the clock though a customer might not always get a session when they need due to unavailability of tutors for their subject at the specific time or due to technology problems or during a site maintenance window.

*Academic Quality
BASE tries to ensure adherence to national and local curricula and standards, however this is not a guarantee. BASE tutors are certified to teach in the country and/or state they reside.

*Technology
BASE uses proprietary, licensed third-party technologies and free technology products. While all attempts are made to ensure stability and availability of technologies used by BASE, the company cannot get guarantee uptime. You are solely responsible for all service, telephony and/or other fees and costs associated with your access to and use of the Services and for obtaining and maintaining all telephone, computer hardware and other equipment required for such access and use.


*Technology
BASE uses proprietary, licensed third-party technologies and free technology products. While all attempts are made to ensure stability and availability of technologies used by BASE, the company cannot get guarantee uptime. You are solely responsible for all service, telephony and/or other fees and costs associated with your access to and use of the Services and for obtaining and maintaining all telephone, computer hardware and other equipment required for such access and use.

Other
This agreement shall be governed by and construed in accordance with the laws of the State of Karnataka, India without giving effect to any principles or conflicts of law. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Notices and procedure for making claims of copyright infringement
Pursuant to relevant Title, section, clause, sub clause and notifications of claimed copyright infringement should be sent to Service Provider's Designated Agent.

THE FOLLOWING INFORMATION IS PROVIDED EXCLUSIVELY FOR NOTIFYING THE SERVICE PROVIDERS REFERENCED BELOW THAT YOUR COPYRIGHTED MATERIAL MAY HAVE BEEN INFRINGED. ALL OTHER INQUIRIES, SUCH AS REQUESTS FOR TECHNICAL ASSISTANCE, REPORTS OF EMAIL ABUSE, AND PIRACY REPORTS, WILL NOT ECEIVE A RESPONSE THROUGH THIS PROCESS.

To be effective, the Notification must include the following:
1. A physical or electronic signature of a person authorized to act on behalf of the owner whose exclusive right is allegedly infringed;
2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
3. Identification of the material that is claimed to be infringing or is the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material;
4. Information reasonably sufficient to permit the service provider to contact the Complaining Party, such as an address, telephone number, and if available, an electronic mail address at which the complaining party may be contacted;
5. A statement that the Complaining Party has good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information in the notification is accurate, and under penalty of perjury, that the Complaining Party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of the written Notification containing the information as outlined in 1 through 6 above:
• Service Provider shall remove or disable access to the material that is alleged to be infringing;
• Service Provider shall forward the written notification to such alleged infringer ("Subscriber");
• Service Provider shall take reasonable steps to promptly notify the Subscriber that it has removed or disabled access to the material.
Counter Notification: To be effective, a Counter Notification must be a written communication provided to the Service Provider's Designated Agent that includes substantially the following:
1. A physical or electronic signature of the Subscriber;
2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
3. A statement under penalty of perjury that the Subscriber has a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled;
4. The Subscriber's name, address, and telephone number, and a statement that the Subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the Subscriber's address is outside of the United States, for any judicial district in which the Service Provider may be found, and that the Subscriber will accept service of process from the person who provided notification or an agent of such person.
Upon receipt of a Counter Notification containing the information as outlined in 1 through 4 above:
• Service Provider shall promptly provide the Complaining Party with a copy of the Counter Notification;
• Service Provider shall inform the Complaining Party that it will replace the removed material or cease disabling access to it within ten (10) business days;
• Service Provider shall replace the removed material or cease disabling access to the material within ten (10) to fourteen (14) business days following receipt of the Counter Notification, provided Service Provider's Designated Agent has not received notice from the Complaining Party that an action has been filed seeking a court order to restrain Subscriber from engaging in infringing activity relating to the material on Service Provider's network or system.
